Terms of Service

Aux Politica LLC (“Aux Politica,” “we,” “our,” or “us”) provides an all-in-one
platform for candidates, campaigns, political committees, PACs, and related
organizations, including websites, software, mobile features, donation tools,
outreach tools, compliance support features, analytics, reporting, and related
services (collectively, the “Services”). These Terms of Use, together with our
Privacy Policy and any applicable additional terms, govern your access to and use
of the Services.
By accessing, browsing, or using the Services, you acknowledge that you have
read, understand, and agree to be bound by these Terms of Use and our Privacy
Policy. If you do not agree, do not use the Services.
1. Eligibility and Account Registration
You may use the Services only if you are legally capable of entering into a binding
agreement and, if using the Services on behalf of a campaign, committee, PAC,
organization, or other entity, you are authorized to bind that entity. You agree to
provide accurate, current, and complete information, maintain the security of
your login credentials, and promptly update your account information as needed.
You are responsible for all activity that occurs under your account. If you suspect
unauthorized access or use, you must notify us promptly using the contact
information listed on our website at https://auxpolitica.com/ .
2. Use of the Services
The Services may enable users to create donation pages, manage supporter
outreach, review analytics, support compliance workflows, manage campaign-
related communications, and perform related operational activities. You agree
that your use of the Services will comply with all applicable laws, regulations,
and industry requirements.
You agree not to:
 Use the Services for any unlawful, fraudulent, misleading, or unauthorized
purpose

 Access accounts, systems, or data you are not authorized to access

 Interfere with the operation, integrity, or security of the Services
 Upload malicious code, viruses, worms, or harmful files
 Reverse engineer, scrape, copy, or exploit the Services except as permitted
by law or with our written consent
 Use automated means to access the Services in a way that imposes an
unreasonable burden on our systems
 Collect or harvest personal information from the Services without
authorization
 Use the Services to send spam or unlawful communications
3. Campaign, Fundraising, and Compliance Responsibilities
Aux Politica provides tools to support campaign fundraising, outreach, reporting,
analytics, and compliance-related workflows. You remain solely responsible for
the legality, accuracy, completeness, and appropriateness of your campaign
activity, fundraising practices, disclaimers, filings, donor handling,
communications, and legal compliance.
Unless expressly stated otherwise in writing, Aux Politica does not provide legal
advice and does not guarantee compliance with campaign finance, election,
privacy, telemarketing, or communications laws. You are responsible for
reviewing all reports, filings, donor information, disclaimers, and
communications before submission, publication, or use.
4. Payments and Donation Processing
If you use donation, payment, or fundraising-related features, you agree to
provide accurate and complete information and to comply with all applicable
payment processing, campaign finance, and fundraising requirements. Third-
party payment processors may apply separate terms, conditions, and fees.
Aux Politica is not responsible for processor outages, banking delays, failed
transactions, chargebacks, reversals, fraud, or actions taken by third-party
payment providers.

5. Privacy, Data Use, and Retention
Your use of the Services is subject to our Privacy Policy. We may collect, use, store,
process, and disclose information as described there. We use reasonable
administrative, technical, and organizational safeguards designed to protect
information, but no system can be guaranteed completely secure.
We may retain data for as long as reasonably necessary to provide the Services,
comply with legal obligations, resolve disputes, enforce agreements, maintain
security, and support legitimate business operations. We may delete or
anonymize data when no longer needed, subject to legal or operational
requirements.
6. Text Messaging and Electronic Communications
If you provide a mobile number or email address, you consent to receive
communications from us related to your account, transactions, security, support,
and use of the Services, including by email, phone, or text message where
permitted by law. Message and data rates may apply.
You represent that you are authorized to provide any contact information
submitted through the Services. You are responsible for complying with all laws
applicable to messages and communications you send using the Services,
including campaign finance, privacy, telemarketing, and anti-spam laws.
7. User Content
You may upload, submit, post, transmit, or otherwise make available content
through the Services, including campaign materials, donor communications,
contact lists, reports, images, and other materials (“User Content”). You retain
ownership of your User Content, but you grant Aux Politica a non-exclusive,
worldwide, royalty-free license to host, store, reproduce, modify, transmit,
display, and otherwise use that User Content as reasonably necessary to operate,
maintain, improve, and provide the Services.
You represent and warrant that you have all rights, permissions, and authority
necessary to provide the User Content and that it does not violate any law or
third-party rights.

8. Intellectual Property
The Services and all related software, technology, branding, text, graphics,
designs, reports, interfaces, and other content provided by Aux Politica
(excluding User Content) are owned by or licensed to Aux Politica and are
protected by intellectual property laws. Except for the limited right to use the
Services under these Terms, no rights are granted to you.
9. Third-Party Services
The Services may contain links to or integrations with third-party websites,
platforms, payment processors, analytics providers, communication tools, or
other services. We do not control and are not responsible for the availability,
content, policies, security, or practices of third parties. Your use of third-party
services is at your own risk and may be subject to separate terms.
10. Suspension and Termination
We may suspend, restrict, or terminate your access to the Services at any time,
with or without notice, if we believe you have violated these Terms, created legal,
financial, reputational, or security risk, or if we are required to do so by law. You
may stop using the Services at any time.
Termination does not limit any rights or remedies that accrued before
termination, and provisions that by their nature should survive termination will
survive.
11. Disclaimers
The Services are provided on an “as is” and “as available” basis. To the fullest
extent permitted by law, Aux Politica and its service providers disclaim all
warranties, express or implied, including warranties of merchantability, fitness
for a particular purpose, title, non-infringement, accuracy, availability, and
security.
We do not warrant that the Services will be uninterrupted, error-free, secure, or
suitable for your specific campaign, legal, compliance, or operational needs.
12. Limitation of Liability

To the fullest extent permitted by law, Aux Politica and its affiliates, officers,
employees, agents, licensors, and service providers will not be liable for any
indirect, incidental, special, consequential, exemplary, or punitive damages, or
for any loss of profits, revenue, data, goodwill, or business opportunities arising
out of or relating to the Services or these Terms.
To the fullest extent permitted by law, Aux Politica’s total liability for any claim
arising out of or relating to the Services or these Terms will not exceed the
amount paid by you to Aux Politica for the Services during the twelve (12) months
preceding the event giving rise to the claim.
13. Indemnification
You agree to defend, indemnify, and hold harmless Aux Politica and its affiliates,
officers, employees, agents, licensors, and service providers from and against any
claims, damages, losses, liabilities, costs, and expenses, including reasonable
attorneys’ fees, arising out of or related to your use of the Services, your User
Content, your campaign activities, your communications, your violation of these
Terms, or your violation of any law or third-party rights.
14. Dispute Resolution
Please read this section carefully. It affects your legal rights. To the fullest extent
permitted by law, any dispute arising out of or relating to these Terms or the
Services that cannot be resolved informally shall be resolved by binding
arbitration in Colorado, except for claims that may be brought in small claims
court or claims for injunctive relief relating to intellectual property or misuse of
the Services.
You and Aux Politica agree to waive any right to a jury trial and to participate in a
class action, collective action, or representative proceeding to the fullest extent
permitted by law.
15. Governing Law
These Terms are governed by the laws of the State of Colorado, without regard to
conflict of law principles, except where applicable law requires otherwise.
16. Changes to These Terms

We may update these Terms from time to time. When we do, we will post the
updated version and revise the Effective Date above. Your continued use of the
Services after the updated Terms become effective constitutes your acceptance of
the revised Terms.

18. Review Note
This draft is designed to preserve much of the legal coverage from the original
Auxilia version while adapting the business language to Aux Politica. It should

finance rules, texting/email compliance, payment processing, arbitration language, and State-specific requirements.
